Terms and Conditions of Sale and Use

Important: Please read this document carefully before purchasing, retaining, or using this product.

By purchasing, retaining, assembling, mounting, or utilizing the MTB Car Rack and its accompanying retention accessories (hereafter collectively referred to as “the Product”), you (the “Buyer”, “User”, or “Customer”) explicitly agree to be bound by the following terms, conditions, and absolute liability disclaimers. If you do not agree to these terms, do not install or use the rack, and return it immediately in its original, unaltered packaging for a full refund.

Section 1: Scope of Intended Use & Mechanical Installation Requirements

The Product is designed, manufactured, and sold exclusively as a vehicular sports-transportation rack intended solely for mounting designated mountain bikes onto compatible consumer vehicles.

User Installation Duty

Proper mechanical installation, vehicle hitch/roof attachment security, and structural pre-ride testing are the 100% exclusive responsibility of the User.

Vehicle Compatibility

The User assumes all responsibility for verifying their specific vehicle’s tongue weight capacities, roof load limits, hitch receiver classifications, and bumper structural integrity before mounting the Product.

Mandatory Component Requirements

The Product is designed to function strictly as a complete system. Users must utilize the proprietary safety tie-downs, integrated straps, and retention pins provided by the Company. Substituting third-party straps, bungee cords, or rope voids all structural guarantees and constitutes unsafe operation.

Section 2: High-Risk Vehicular Operation & Safety Warnings

Transporting heavy mountain bikes at highway speeds involves inherent aerodynamic forces, structural vibrations, and catastrophic risks if neglected.

Pre-Trip & En-Route Inspections

The User is strictly required to inspect the rack’s hitch connection, structural bolts, and wheel straps before departure, after the first 10 miles of driving, and at every 50-mile driving interval thereafter.

Dynamic Ground Clearances

The User assumes all operational risks associated with altered vehicle dynamics, including changed rear departure angles, steep driveway bottom-outs, overhead garage clearances, automatic car wash damage, and backing-up collisions.

Environmental Driving Adjustments

The User must adjust driving habits (including reducing highway speeds, slowing down over speed bumps, and taking cautious turns) when navigating rough off-road terrain, fire roads, or driving in high-wind conditions with bikes loaded.

Section 3: Absolute Limitation of Liability & Vehicular Failure Disclaimers

To the maximum extent permitted by applicable law, the Company, its founders, manufacturers, and distributors shall not be held liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from the purchase, installation, structural failure, or vehicular detachment of the Product.

Catastrophic Detachment & Road Fall Liability

The Company is strictly not responsible or legally liable for scenarios where the rack, or individual mountain bikes secured to it, loosen, shift, or completely fall off the vehicle onto roadways, highways, or private properties. The User assumes all financial and legal liability for trailing-vehicle collisions, third-party property damage, multi-car highway accidents, or traffic citations resulting from loose cargo or rack detachment.

Vehicle & Bike Damage

The Company explicitly disclaims liability for any physical damage inflicted upon the host vehicle (including dented tailgates, scratched paint, bent hitch receivers, or exhaust-heat melting) or damage to the transported mountain bikes themselves (including fractured carbon frames, bent wheels, or sheared fork dropouts).

Labor & Financial Loss

The Company shall not be liable for medical expenses, towing fees, vehicle down-time, race or event entry fees, or third-party auto-body shop repair invoices.

Financial Cap

In no event and under no legal theory shall the Company’s cumulative financial liability to the Buyer exceed the original purchase price paid directly for the bike rack fixture itself.

Section 4: Limited Hardware Warranty

The Company warrants to the original retail purchaser that the foundational steel/aluminum structural components of the rack will be free from factory defects in material and craftsmanship for a period of one (1) year from the verified date of delivery.

Exclusions

This warranty strictly excludes coverage for cosmetic paint weathering, powder-coat chipping, rust from road salt exposure, UV strap degradation, or any structural failure caused by exceeding specified weight limits, off-road overloading, rear-end vehicle collisions, or failure to use the provided mandatory safety tie-downs.

Sole Remedy

The Company’s exclusive obligation under this warranty is restricted to the repair or component replacement, at its sole discretion, of the broken structural part upon the physical return of the rack by the Buyer.
